Pharmacy portal terms

These terms are an agreement between MapSorix Innovations Inc. of Saskatoon and each pharmacy that uses the MapSorix Care pharmacy portal. They also set the rules for every person at the pharmacy who signs in to it.

Draft: these terms are being reviewed by our lawyer before launch and may change.

Agreeing to these terms

Who agrees
“We” and “MapSorix” mean MapSorix Innovations Inc. “Your pharmacy” means the pharmacy whose account you use. The person who opens your pharmacy’s account accepts these terms for the pharmacy and for themselves, and confirms that they have the authority to do so. Every other person at your pharmacy accepts them for themselves the first time they sign in, and everyone accepts them again whenever they change.
What else applies
Our privacy policy says what we record about the people at your pharmacy, and why. Each care home’s own agreement with MapSorix governs that home’s records, and these terms give your pharmacy no right to them. Our terms for care homes and their staff do not apply to your pharmacy.

The portal

What it is
A part of MapSorix Care where a pharmacy that serves a personal care home can, for each home it is paired with, send the home documents such as medication lists and orders for its nurses to check, see whether each was accepted or rejected, and answer the requests the home sends. It replaces fax and phone for those exchanges, and nothing else.
Pairing with a home
A home’s administrator gives your pharmacy a one-time code, and approves your pharmacy before it sees anything of the home. The home can end the pairing at any time. From then your pharmacy sees nothing of that home, and the copies the portal held for it are deleted.
No charge
The portal is free to your pharmacy. If we ever want to charge for it, we will tell your pharmacy’s managers at least 90 days ahead, and nothing is charged unless your pharmacy agrees in writing.
Not your pharmacy’s records
The portal is not your pharmacy’s record system. Keep in your own records everything the law and the Saskatchewan College of Pharmacy Professionals require you to keep, because the portal’s copies are deleted when a pairing ends.
A request is not a prescription
A request from a home asks your pharmacy to act; it is not a prescription. Dispense only on a valid prescription and your own professional judgement. The portal gives no clinical advice. Where it reads a name and date of birth from a document to help the home sort it, that helps the home’s nurses and is not a check your pharmacy can rely on.

Your pharmacy’s people

One sign-in each
Each person has their own sign-in, with a password and an authenticator app, and never shares it or signs in as someone else. Everything done under a sign-in is recorded with that person’s name, and each home sees what was done for it.
Managers
Your pharmacy keeps at least one manager. Managers add only people who need the portal for their work at the pharmacy, remove them promptly when they leave or no longer need it, and keep their names and email addresses correct. A manager can reset a colleague’s authenticator app. If your only manager loses theirs, we reset it after phoning your pharmacy on a number a paired home holds for it, and we tell that home.
Your pharmacy answers for its people
Your pharmacy is responsible for what its people do in the portal, as if it had done it itself.
If a sign-in may be misused
If someone else may know a password or have an authenticator app, or a computer with the portal open is lost, change the password and tell us at once at care@mapsorix.com or (306) 400-1800.

Residents’ information

Your pharmacy’s duty
With each request, a home shows your pharmacy the resident’s name, room and bed, date of birth and allergies, and what it is asking for. Your pharmacy is a trustee of that information under The Health Information Protection Act (HIPA), and protects it as HIPA and its professional standards require.
Use it only to serve the resident
Use what a home sends only to dispense to and care for that resident. Look only at what your work requires, and don’t copy, download or share it beyond that.
Something not meant for you
If a request is about someone your pharmacy doesn’t serve, don’t act on it. Tell the home, and delete any copy you made unless the law requires you to keep it.
Documents you send
Send a home only documents about its residents whom your pharmacy serves, and check the home before you send. Your pharmacy decides to disclose each document and is responsible for that decision. If you send a document to the wrong home, phone that home and tell us the same day. Once a home receives a document it is in the home’s care: we keep it for the home under the home’s agreement with us, and only the home decides what happens to it.
If information is lost or misused
If you learn that residents’ information from the portal may have been lost, stolen, or seen or shared without authority, tell the home and us as soon as you can, and within 48 hours, and help us find out what happened.

Using the portal properly

What not to do
Don’t try to reach a home, record or account you have not been given. Don’t test, probe or get around the portal’s security, or use automated tools to read or send through it. Send only documents for a home and answers to its requests: nothing harmful, nothing unrelated, and no advertising.
Suspending access
We may suspend a person, or your pharmacy’s account, at once to protect residents’ information or the service, or if these terms are broken. We tell your pharmacy’s managers and the homes concerned why as soon as we can, and restore access once the reason has gone.

What we do

Our part
We run the portal with care and keep it secure, keep its information as our privacy policy describes, and record each step in the audit trail of the home it concerns. We carry what passes between your pharmacy and a home on their instructions, and decide nothing about what is sent.
Availability
We aim to keep the portal available, but it is free and provided as it is, without a promise that it will always be available or free of faults. Keep your phone and fax for anything urgent. We may change the portal, and we tell your pharmacy’s managers at least 30 days before we remove something they use, unless security requires it sooner.

Responsibility

Our limit
As far as the law allows, our total liability to your pharmacy for everything to do with the portal is limited to $10,000, and we are not liable for indirect loss, or for lost profit, revenue or business. This does not limit liability for fraud, deliberate wrongdoing or gross negligence, or anything else the law does not allow to be limited.
Your pharmacy’s part
Your pharmacy is responsible for its dispensing and other professional services, for the documents it sends, and for its people’s use of the portal, and will compensate MapSorix for claims by others that arise from them or from a breach of these terms. If your pharmacy sends a document to the wrong home or about the wrong resident, it also pays MapSorix’s reasonable costs of dealing with it.

Ending, and changes

Ending
Your pharmacy can close its account at any time by asking us at care@mapsorix.com. We can close an account that has had no paired home for 12 months, end these terms with 30 days’ notice, or end them at once if they are seriously broken. When an account closes, every sign-in is turned off and the portal’s copies are deleted. The homes keep their own records of what was sent and done, as the law requires them to.
Changes
If we change these terms we post the new version with a new date, and email your pharmacy’s managers at least 30 days before it takes effect. Each person is asked to accept the new version when they next sign in, and a manager accepts it for the pharmacy. If your pharmacy doesn’t accept a change, close its account before then.
What continues
What these terms say about residents’ information, responsibility and the law continues after an account closes.

General

Notices
We give notice to your pharmacy by email to its managers, and your pharmacy gives notice to us at care@mapsorix.com. An email counts as received on the next business day unless the sender is told it was not delivered.
The law
These terms are governed by the laws of Saskatchewan and the laws of Canada that apply there, and the courts of Saskatchewan decide any dispute.
The whole agreement
These terms and our privacy policy are the whole agreement about the portal. Your pharmacy may not transfer them without our written consent. We may transfer them to whoever takes on MapSorix Care and agrees to keep them.
